The National Energy Administration Releases State Power Demonstration Project Management Methods

   On November 22, the National Energy Administration released the State Power Demonstration Project Management Methods on its official website, specifying such aspects as application, assessment, and optimization and approval of the demonstration projects.

     Application for the demonstration project

   The enterprise groups directly planned by the state and the enterprises underthemanagement of the Central Government shall submit its application for participate in the demonstration project to the National Energy Administration after being approved by the competent energy agencies of the provincial government where the project is based in accordance with the contents of the demonstration projects confirmed by the National Energy Administration. Other enterprises shall submit the demonstration project application to the competent energy agencies of the provincial government where the project is based. Any project with the same demonstration contents in its joint application (including those jointly by the main engine plant and the designing institute) shall not be repeatedly applied for.

    The project unit shall submit the implementation plan of the demonstration project, with the specific contents including overview of the demonstration project, engineering proposal, research report of the demonstration project, relevant work basis and achievements of the project unit, the project implementation plan, the intellectual property right management, etc.

     Appraisal and optimization of demonstration project

    Except for the necessary conditional argument for appraisal and optimization of demonstration project, we shall strictly prove the overall feasibility and demonstration effect of the project from the aspects as to technical plan, planning arrangement, industrial policy and industrial development and prohibit any new investment in the power project in the name of demonstration.

State Power Demonstration Project Management Methods

     To deeply implement the spirit of the Fifth Plenary Session of the 18th Communist Party of China, the sixth meeting of the Leading Group of Financial and Economic Affairs and the outline of the 13th Five-year Plan, practice the development concept of “innovation, coordination, green, opening up and sharing,” boost the implementation of the strategic energy thought which features “four revolutions and one cooperation,” put the leading role in the technical innovation in energy in to full p lay, boost the development of the industrial sector which features high efficiency and green and low carbon and strengthen the demonstration project management of power projects (including the projects in thermal power, power grid and system stored energy projects, the same below), we hereby formulate the following Methods.

     Article 1 Definition and scope of demonstration project

    The demonstration projects referred to in these Methods means the advanced electric power technology and equipment which feature the original innovation in the application, integrated innovation and independent intellectual property rights, and can fill in the gap in the domestic technology, as well as the power engineering construction projects which remarkably promote the high-efficient, clean, green and low-carbon, and sustainable development of the power industry and exert positive and leading role in the power structure adjustment, system capability optimization, electric power sector upgrading and energy saving and emission reduction, and go through the approval and procedures as specified. The direction and contents of the demonstration projects comply with the relevant requirements for the national electric power development strategy and planning, the power industrial policy and energy science and technology planning.

     Article 2 Determination of demonstration contents

   The National Energy Administration determines the contents of the power demonstration project to be conducted as per the relevant requirements for the strategy and planning, of the power industry, the power industrial policy and the energy scientific planning, and collects the intention of demonstration from relevant local government departments and enterprises. The demonstration contents shall ensure that they are of significant meaning for the transformation and upgrading of the power industry, and enhance the level and the existing power technology and equipment remarkably through innovation.

     Article 3 Application for demonstration project

   The enterprise groups directly planned by the state and the enterprises under the management of the Central Government shall submit its application for participate in the demonstration project to the National Energy Administration after being approved by the competent energy agencies of the provincial government where the project is based in accordance with the contents of the demonstration projects confirmed by the National Energy Administration.

         Article 4 Appraisal and optimization of demonstration project

    The National Energy Administration organizes experts or entrusts consulting agencies with due qualification to respectively conduct the engineering scheme argumentation and the special appraisal of project program of the demonstration project in accordance with the Notice of the National Energy Administration on the Printing and Distributing of the Management Methods of the Significant Demonstration Projects of the National Energy Science and Technology (GNKJ[2012]No.130). Except for the necessary conditional argument for appraisal and optimization of demonstration project, we shall strictly justify the overall feasibility and demonstration effect of the project from the aspects as to technical plan, planning arrangement, industrial policy and industrial development and prohibit any new investment in the power project in the name of demonstration.

    In case that multiple project units apply for the same demonstration contents, the experts or consulting institutions shall put forward opinions after optimization of them, and the National Energy Administration shall select the successful projects after being appraised or optimized as the demonstration projects based on the appraisal and optimization opinions of such experts or consulting institutions, and incorporate them into the national power construction planning.

     Article 5 Approval of demonstration project

   The demonstration project incorporated into the national power construction planning shall be examined and approved by the development and reform departments at all levels as per the limit of approval authority.

    The documents examined or replied for the demonstration project shall clarify the contents and targets of the demonstration, and taken as the main basis for the assessment and inspection after the demonstration project has been completed; meanwhile, during the construction of the project, in principle, the demonstration proposal shall be adjusted. In case of any significant adjustment to the demonstration proposal, the applicant shall re-apply with the National Energy Administration for approval, and have the proposal reexamined or approved in accordance with relevant provisions.

     Article 6 Implementation of demonstration projects

   The competent energy department where the project is based shall assist the project unit to get the external construction conditions as to land, water, environment protection, power grid access for the project available and supervise the construction of the project in accordance with laws and rules. In case that the project gets involved in any breach of laws or rules during the construction or performance of the project in accordance with the demonstration proposal, the qualification of the demonstration project shall be revoked and an announcement thereof shall be made.

     Article 7 Policy of demonstration project

   The demonstration project singly incorporated into the national power construction planning. In thermal power projects, priority shall be placed on the conditions of construction. In the condition favorable to the performance of the demonstration project, we shall optimize the regional arrangement of the power market space and the scale of construction shall be incorporated into the overall consideration for balance of electric power and energy in the region where the project is based. We shall prioritize the protection of the project as per the principle of energy saving and low carbon to protect the utilization rate and reasonable benefits of the demonstration project, thus to the greatest extent putting the role of the demonstration.

    The demonstration project is entitled to the supportive policy expressly specified in the Notice of the National Energy Administration on the Printing and Distributing of the Management Methods of the Significant Demonstration Projects of the National Energy Science and Technology (GNKJ[2012]No.130).

      Article 8 Assessment and examination of demonstration project

     Upon completion of the demonstration project, the National Energy Administration will organize experts or entrust a consulting agency with due qualification to conduct post-assessment and examination of the demonstration project in accordance with the examination or approval contents, implementation scheme and operating results of the demonstration project, and conduct the post-assessment of the same.

    Article 9 Promotion and application of the demonstration technology

  The National Energy Administration will organize experts or entrust a consulting agency with due qualification to conduct the assessment and authentication of the demonstration technology adopted in the demonstration project based on the assessment and examination of the demonstration. The National Energy Administration will organize the promotion of the project in case that the full assessment argumentation show that the demonstration technology is advanced and reliable, mature and suitable, with the broad application prospect, and support the project unit to apply for the ownership and patent protection of the intellectual property rights in accordance with the relevant laws and rules of the State.
